Please read the Terms of Use (Terms) below before using our site or any of its features, collectively referred to below as Zócalo, Zócalo Public Square, or the Site. By using the Site, you agree to be bound by these Terms of Use, our Privacy Policy, and our Code of Civility. We reserve the right to modify or delete portions of these terms or add to them at any time by posting here, to our Privacy Policy, or to our Code of Civility. Any changes are effective immediately upon posting here. By continuing to use the Site, you agree to be bound by any and all changes. Any new features or functionality we add to our Site as we grow are subject to these Terms of Use unless expressly stated otherwise.
Please note that Zócalo’s Terms of Use are distinct from the Terms of Use of any other organization or website linked to from the Site. Zócalo is not responsible for the policies of those third parties.

Copyrights

The Site is protected as a collective work by U.S. and international copyright laws. All individual articles, videos, photos, and other elements are also protected by U.S. and international copyright laws. The contents of the Site, including all written work, audio and video podcasts, other video content, photographs, and other features are owned by or licensed to Zócalo Public Square. User materials are licensed to Zócalo Public Square, subject to the section User Materials below. We respect your right to make “fair use” of the materials contained on the Site; accordingly, you may from time to time excerpt and use materials set forth on this Site, provided that you give credit both to the original author or content producer and to Zócalo Public Square, and provided that the use if for non-commercial purposes only. No quotes from any material on our Site may be used without attribution to the original author and to Zócalo Public Square. Use of our content cannot in any way be unlawful or harmful to any other person or entity. Unless expressly permitted, you may not copy, reproduce, distribute, publish, enter into a database, display, perform, modify, create derivative works, transmit, or in any way exploit any part of this Site, except as permitted in this section. All rights not expressly granted in these Terms of Use are reserved to Zócalo Public Square. Events

Zócalo Public Square welcomes participants to its Events, where we seek to create an open and civil environment of mutual respect, and where all participants can feel welcome. Participants include but are not limited to patrons in attendance at an Event, guest speakers, Zócalo and third party event personnel including media and venue partners, volunteers, presenters, and security. Zócalo reserves the right to change or cancel any of its Events. Zócalo is not responsible for, and does not endorse, any statement made by any Event participants. Zócalo Public Square is not responsible for any losses suffered by patrons as a result of attending an Event; patrons attend Zócalo Events at their own risk. Zócalo Public Square reserves the right to remove, deny entry, or otherwise deny access to Events and the Site to any persons at its sole discretion, for any reason. Trademarks

Zócalo Public Square, its logo, and its tagline are service marks of our organization. All rights are reserved by Zócalo Public Square. You may not use any Zócalo logos or taglines without Zócalo’s express consent, except you have the right and the obligation to use Zócalo’s name and logo included in or in connection with any use of our media content such as, for example, re-posting our video content.

User Materials

Zócalo Public Square welcomes comments and other content from its users (User Materials). We reserve the right to screen, refuse to post, remove or edit User Materials at any time in our absolute and sole discretion without prior notice. As we screen or edit, there may be a delay in the posting of such content to allow for a review process. If we have questions about your User Materials, we have the right but not the obligation to contact you. You retain the copyright and other ownership rights to any User Materials you submit to the Site. However, by submitting User Materials, you hereby grant Zócalo Public Square a non-exclusive, perpetual, royalty-free, worldwide, transferable license to use, copy, sublicense, modify, transmit, display, create derivative works of, host, index, cache, and/or otherwise use your User Materials on the Site and for any other organizational purposes, without payment and without further consent or notice to you. You further grant Zócalo the right to contact you in connection with your User Materials and to use any identifying information you provide in connection with your User Materials.
For any User Materials you submit to Zócalo, you agree to abide by the rules set forth in this section. User Materials may not be libelous, defamatory, false, obscene, pornographic, abusive, threatening, harassing, discriminatory, unlawful, harmful to minors, in violation of privacy rights, or constituting hate speech or personal attacks. You may not submit User Materials for which you do not have copyright or other necessary permissions, for commercial purposes, or for purposes of interfering with or disrupting the performance of the Site or any portion thereof. You may not impersonate another party or otherwise falsely represent yourself in your User Materials. By submitting user materials, you verify that you abide by these rules and that you are solely responsible for any User Materials submitted. Zócalo Public Square is not responsible or liable for any User Materials, and Zócalo cannot and does not have the duty to verify the accuracy, integrity, or quality of User Materials.

Minors

Zócalo Public Square welcomes comment and participation from its users between the ages of 13 and 18 with the express permission of their guardians. If you are under 13 years of age, please do not submit User Materials or any other information about yourself to the Site. Zócalo does not knowingly collect information about minors under 13 years of age.

THE SITE AND ANY CONTENT, MATERIALS, USER MATERIALS OR OTHER FEATURES AVAILABLE THROUGH THE SITE ARE AVILABLE ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. ZÓCALO PUBLIC SQUARE DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE. NOR DOES ZÓCALO WARRANT AS TO THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE, OR MAKE ANY WARRANTIES AS TO THE ACCURACY, RELIABILITY OR CONTENT OF THE SITE OR ANY CONTENT THEREIN. Limited Liability

You agree to indemnify and hold harmless Zócalo Public Square and its affiliates, and their respective members, directors, officers, managers, employees, shareholders, agents, and licensors, from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from (a) any violation by you of these Terms, (b) inability to use or discontinuation of the Site or any of its components, (c) in connection with any third-party content or materials including User Materials, or (d) the conduct of any third party. We reserve the right to take over the exclusive defense of any claim for which we are entitled to indemnification under this Section. In such event, you shall provide us with such cooperation as is reasonably requested by us.
